Abstract: This research discusses the criminal liability of the public employee in Libyan legislation, and aims to clarify the concepts and variables related to the subject of the research in terms of the disciplinary penalties approved by the Libyan legislator in the event of an administrative violation or negligence, and their effect in deterring the employee, relying on the descriptive approach with the aim of providing a theoretical and analytical framework for the Libyan laws and the answer. To address the questions raised and learn about the position of the criminal legislator on the crimes committed by the public employee, and the impact of the punishment on him, by asking several questions centered around the subject of the research. The research was divided into two sections, each section has two requirements. The research reached several results, the most important of which is: The criminal legislator must reconsider the punitive texts for the public employee. Public administrations must organize awareness seminars that clarify the employee’s duties and rights, and explain the foundations of criminal liability and disciplinary penalties in administrative work.
