آليات القانون الدولي في مواجهة القرصنة البيولوجية البشرية وحماية السيادة الرقمية للبيانات الجينية للشعوب النامية

الملخص
تُعالج الدراسة ظاهرة "القرصنة البيولوجية البشرية" وتحوّلها من استغلال مادي للعينات إلى قرصنة رقمية تستهدف التسلسل الرقمي الجيني (DSI) لشعوب الدول النامية عبر المنصات المفتوحة. وتستقصي الدراسة، بمنهج تحليلي نقدي، مدى كفاية الصكوك الدولية الحالية -كإعلانات اليونسكو واتفاقيات الملكية الفكرية- في الحد من هذه الممارسات التي تتستر بغطاء البحث العلمي وبراءات الاختراع، في ضوء مبادئ القانون الدولي وسيادة الدول على مواردها، وتخلص الدراسة إلى وجود فجوة تشريعية دولية تسمح باستغلال الجينوم البشري دون موافقة مستنيرة أو تقاسم عادل للمنافع موصيةً بصياغة معاهدة دولية ملزمة تضمن "السيادة الجينية الرقمية" وتُجرّم الاستعمار الجيني الحديث................... الكلمات المفتاحية:................ القرصنة البيولوجية البشرية؛ السيادة الجينية الرقمية؛ معلومات التسلسل الرقمي (DSI)؛ الشعوب النامية؛ القانون الدولي لأخلاقيات البيولوجيا.
Abstract
This research explores human biopiracy and its development, from the misuse of physical samples to digital piracy utilizing open-access Digital Sequence Information (DSI)of human genomes from developing countries. Using a critical analytical approach, it examines this phenomenon under public international law, with an emphasis on state sovereignty and genetic privacy. The study investigates whether current global accords—such as UNESCO declarations and intellectual property treaties—can help to prevent this abuse, which masquerades as patents and free research. The study suggests creating a binding international treaty to ensure digital genetic sovereignty and outlaw modern genetic colonialism, thereby closing a legislative gap that permits exploitation without prior informed consent or fair benefit-sharing................
