Abstract
This study examines crimes resulting from the breach of official duties under Palestinian legislation, based on the premise that public office is a trust exercised to serve the public interest, and that any deviation from this purpose may transcend mere disciplinary misconduct to constitute a criminal offense. The research problem stems from the multiplicity of legal provisions addressing such breaches, as well as the overlap between various criminalized acts; this complicates the process of determining the precise legal classification of a given incident and distinguishing between disciplinary liability and criminal liability. The study employs a descriptive-analytical approach, analyzing relevant legal provisions, scholarly legal opinions, and judicial precedents. The study focuses on four primary categories: abuse of power, exploitation of influence, failure to execute judicial rulings, and obstruction of the course of justice. It clarifies that abuse of power relates to an official’s deviation in the exercise of their authority, whereas the exploitation of influence may occur when an individual exerts pressure on a decision-making authority, even if the individual themselves does not issue the final decision. Furthermore, the study explains that the obstruction of a judicial ruling may manifest as a total or partial failure to execute it, or through deliberate procrastination. It also notes that the obstruction of the course of justice can begin as early as the investigation or inquiry stage—for instance, by influencing witnesses or tampering with evidence. The study concludes that it is essential to examine the grounds and documentation for administrative decisions, to document the procedures for executing judicial rulings, and to verify an employee’s official status, jurisdiction, and intent before establishing their criminal liability. It recommends the implementation of registries to document decisions and track the execution of judicial rulings, the enforcement of conflict-of-interest disclosures, the provision of secure channels for reporting interference in investigations, and the training of employees regarding the limits of their authority and the legal consequences of failing to fulfill their duties....................
